The question is how many people are there. That is a fact independent of what the capacity is. It might have been after New Years when they cracked down on that upper level capacity (which would lead nicely to admin's claim that the Feds were over-crowding on New Years and prior).

About the patio. I've been told in the past that the doors have been propped open and the capacity of it included in the total capacity. In these situations patrons would not be allowed to go on the patio. It would usually be for a concert or something like that.
