burden of proof?

Anyone know anything about the legal situation here? Clearly it's not as simplistic as Simon suggested.

My impression is that if the guys doing the beating were drunk, and can be shown to have gotten drunk at Fed Hall, then Fed Hall would be liable. Otherwise, probably not.

Where is the burden of proof? Does the University have to show they were loaded, or do the Feds have to show they weren't?
